A woman from Watertown, South Dakota won a case last month against GlxoSmithKline, the manufacturers of Paxil, for causing conditions leading to the death of her son. Jennifer Berg sued the company after her son died from a heart condition she claimed was caused by her use of Paxil while she was pregnant with the boy.
Berg and her legal team claimed that the company failed to warn her and others of a link between use of Paxil during pregnancy and heart complications in children. While no settlement documents have been made public, letters from Berg’s lawyers to the presiding judge reveal that a settlement has been reached, an Associated Press article reports.
The article said that, “GlaxoSmithKline said last week that it expects to take a $2.36 billion charge against second-quarter earnings for settlements, agreements to settle and other provisions for long-standing legal cases over Paxil, the diabetes drug Avandia and other issues.” Settlement details will not be made public.
Berg’s son Nathan died in a Minneapolis hospital 58 days after he was born with persistent pulmonary hypertension of the Newborn. The lawsuit states that GlaxoSmithKline was or should have been aware of the dangers of ingesting Paxil while pregnant.
A Philadelphia woman who took Paxil while she was pregnant was awarded $2.5 million in October of 2009 after her son was born with heart defects. The FDA has been warning consumers of potential dangers of taking Paxil while pregnant since September of 2005, the AP article reported.
The Detroit Alternative Medical Examiner recently published an article on the connections between Paxil and birth defects, with advice for natural remedies and other non-drug options for treating depression while pregnant. The FDA has not yet gone beyond issuing warnings about Paxil’s connection to birth defects.
